Terms and conditions
Effective from the date of publication. The shop sells digital
content (downloadable files) only.
1. General provisions
- The online shop at https://landecka.com is operated by Hakan Architektura Krajobrazu Patrycja Landecka,
ul. Krakowska 56, 24-220 Niedrzwica Kościelna, Poland, VAT ID (NIP) 713-270-46-87 (the “Seller”).
- Contact: patrycja@landecka.com, +48 505 822 460.
- These terms set out the rules for purchasing digital products — ready-made garden
designs delivered as electronic files.
2. Products
- The products are packages of garden design documentation delivered exclusively
in electronic form.
- Each package contains five design variants together with documentation: planting
layout sheets, a plant list, an irrigation and lighting design, plant descriptions,
visualisations and a film presenting the garden.
- The product is a standard design intended for self-adaptation. It is not prepared
individually for a specific plot and does not replace a building design or any
documentation required by construction law.
- The Seller does not guarantee that every plant listed will be available at nurseries
in a given season. Alternatives are provided.
- All prices are gross prices in Polish zloty (PLN).
3. Orders and conclusion of the contract
- Orders are placed through the shop form by providing an e-mail address for delivery
of the files and by accepting the required statements.
- Acceptance of these terms and the statement referred to in section 6(2) is required.
- The contract is concluded once payment has been made successfully.
- The customer is responsible for providing a correct e-mail address.
4. Payments
- Payments are handled by Autopay S.A., an electronic payment operator.
- Available methods: BLIK, fast online bank transfer and payment card.
- The Seller has no access to the customer's card details.
- An invoice is issued on request — simply provide the details in the order form.
5. Delivery of digital content
- Once payment clears, the customer receives an e-mail containing an individual
download link.
- Delivery takes place immediately, usually within a few minutes of the operator
confirming the payment.
- The link is valid for 30 days and each file may be
downloaded up to 10 times. After that period the customer may
ask the Seller to restore access.
- To open the files you need: an internet connection, a web browser, a PDF reader
and a video player. Files may be large — a fixed broadband connection is recommended.
6. Right of withdrawal — digital content
- A consumer is generally entitled to withdraw from a distance contract within 14 days
without giving a reason.
- This right does not apply to contracts for the supply of digital content not
supplied on a tangible medium, where performance has begun with the consumer's prior
express consent and after the consumer acknowledged that they would thereby lose the
right of withdrawal (Art. 38(13) of the Polish Consumer Rights Act of 30 May 2014).
- When placing an order, a consumer ticks the relevant statement in the form, consenting
to delivery before the withdrawal period expires and acknowledging the loss of the
right of withdrawal. The statement is recorded together with its date and IP address.
- The above applies accordingly to a natural person concluding a contract directly
related to their business activity where the contract is not of a professional
character for that person.
7. Licence and copyright
- All products are works protected under the Polish Act on Copyright and Related Rights.
- The customer receives a non-exclusive, non-transferable licence for
a single use for their own needs, on one property.
- Resale, sharing, publishing, lending or distributing the files in any form is
prohibited, as is using them to provide design services to third parties.
- The customer may make a backup copy for their own use.
8. Complaints
- Complaints should be sent to patrycja@landecka.com together with the order number
and a description of the problem.
- The Seller responds within 14 days of receipt.
- A complaint may concern in particular: inability to download the files, damaged
files, or files not matching the description.
- If the complaint is upheld, the Seller makes the files available again or, where
that is not possible, refunds the amount paid.
9. Personal data
- The controller of personal data is the Seller.
- Details are set out in the Privacy policy.
10. Out-of-court dispute resolution
- Consumers may use out-of-court complaint and redress procedures, including the ODR
platform at https://ec.europa.eu/consumers/odr.
- Use of these methods is voluntary.
11. Final provisions
- Matters not covered here are governed by Polish law.
- The Seller may amend these terms. Orders placed before an amendment are governed by
the terms in force at the time the order was placed.
Note: this is a template prepared for the sale of digital
products. Before publication it should be reviewed by a lawyer.
